WHEREAS, pretrial motions, including those addressing Daubert issues 
related to dispositive motions (“Pretrial Motions”) are due October 17, 2025 (ECF 
521); 
WHEREAS, the parties have met and conferred and agree to jointly request a 
briefing schedule for the Pretrial Motions and excess pages for the briefing on 
Defendant Bank of America, N.A.’s (“Defendant’s”) anticipated motion for partial 
summary judgment as set forth below; 
NOW THEREFORE, the parties hereby jointly move the Court to enter the 
Proposed Order setting the briefing schedule for the Pretrial Motions and extending 
the page limits for the parties’ briefing on Defendant’s motion for partial summary 
judgment as follows: 
1. 
Pretrial Motions are due on Friday, October 17, 2025; 
2. 
Oppositions to Pretrial Motions are due on Friday, January 9, 2026; 
3. 
Replies in Support of Pretrial Motions are due on Friday, February 20, 
2026;  
4. 
The Pretrial Motions shall be heard on Friday, April 17, 2026, or on such 
other date as determined by the Court; 
5. 
Defendant’s opening brief in support of its partial motion for summary 
judgment shall not exceed 50 pages, and Defendant’s separate statement 
of undisputed material facts in support of same shall not exceed 50 
pages; 
6. 
Plaintiffs’ opposition to Defendant’s partial motion for summary 
judgment shall not exceed 50 pages, and Plaintiffs’ response to BANA’s 
separate statement of undisputed material facts in support of same shall 
not exceed 50 pages; 
7. 
Defendant’s reply brief in support of its partial motion for summary 
judgment shall not exceed 25 pages; and 
8. 
All other Pretrial Motions including those addressing Daubert issues
