The Restaurant Revitalization Fund
$28.6 billion in grants to restaurants and bars, opened on May 3, 2021 and closed nine weeks later when demand ran past the money. Every figure on this page links to the record it came from.
What the program was
The American Rescue Plan Act became law on March 11, 2021 (Public Law 117-2); section 5003 established the Restaurant Revitalization Fund and appropriated $28.6 billion for the SBA to award (SBA program guide, April 28, 2021). Grants ran up to $5 million per physical location and $10 million per applicant and its affiliates, for restaurants and similar places of business with pandemic revenue loss; unlike most SBA programs there was no employee-count limit, but an applicant and its affiliates could not have owned or operated more than 20 locations as of March 13, 2020 (CRS In Focus IF11819, August 15, 2022). Funds had to be used on eligible expenses by March 11, 2023 (program guide).
The statute required the SBA to award grants only to businesses owned and controlled by women, veterans, and socially and economically disadvantaged individuals during the program's first 21 days, then in the order applications were approved (CRS IF11819). One denial reached court: the archive holds the memorandum opinion and order of dismissal of January 10, 2024 in Collins v. SBA, brought by an applicant who alleged the SBA wrongly denied her bakery's application; the court granted the government's motion to dismiss.
Applications ran on SBA Form 3172, and recipients reported their use of funds on Form 3173. Two earlier bills, the Restaurants Act of the 116th Congress, H.R. 7197 and S. 4012, the Senate bill of the same name, sit in the statute section as references. A replenishment bill, H.R. 3807, was introduced on June 11, 2021 and passed the House on April 7, 2022; it would have added $42 billion (CRS IF11819).
Key dates and amounts
- The portal opened at noon on May 3, 2021 after a seven-day pilot. By May 12 the SBA had received more than 266,000 applications requesting more than $65 billion; by June 30, more than 278,000 eligible applications requesting more than $72.2 billion, with grants to about 101,000 applicants. The SBA announced the fund's closure on July 2, 2021 and kept the portal open until July 14 for status checks and corrections (CRS IF11819).
- The SBA OIG's March 2024 audit puts it as 278,300 applications requesting $72.2 billion, about 101,000 approved, and all $28.6 billion disbursed, and found that the agency's award-control plan did not include all program requirements and was not always followed (OIG Report 24-09).
