PLEASE TAKE NOTICE that on June 5, 2025, the Supreme Court of the United 
States issued an Opinion that dismissed the writ of certiorari as improvidently granted in 
Laboratory Corporation of American Holdings dba LabCorp v. Luke Davis, et al., No. 
24-304, 605 U.S. ___ (2025). This opinion is attached hereto as “Exhibit A” and is relevant 
to Plaintiffs’ Motion for Class Certification (Dkt. 386-2) and the Court’s Order Granting 
Defendant’s Motion to Stay Pending Supreme Court Review as it relates to class 
certification and subsequent dispositive motion practice (Dkt. 448). Accordingly, 
Plaintiffs respectfully request that the Court lift the existing stay and, at its earliest 
convenience, decide Plaintiffs’ fully briefed and argued Motion for Class Certification.
