1 BANA’s proposed opposition date takes into consideration Plaintiffs’ failure to 
notify BANA and its counsel of their intent to file the ex parte motion before it was 
filed.  Additionally, Plaintiffs’ ex parte motion does not comply with Local Rule 
83.3(g) because it does not include either an affidavit identifying Plaintiffs’ 
attempts to notify BANA prior to filing or any reason that notice should not be 
required.
