After hearing argument from the parties, the Court overruled the Defendant’s objection. The Government requested that the restitution amount be increased to $46,004.04, to reflect amounts the Defendant received from a “third fraudulent Covid relief loan from a separate program” totaling $4,000.00 plus interest. (Doc. 32 at 2.) Having no objection from Defendant as to the requested additional amount, the Court granted the Government’s request and directed Probation to modify the presentence report as requested by the Government. Having no further objections to the presentence report, the Court adopted the findings of fact and conclusions of law, as modified. After hearing argument from the parties, the Court granted the two-level downward adjustment for acceptance of responsibility. There were no objections to the guideline calculations. The Court heard arguments from the parties regarding their recommended sentence. The Court granted the parties’ joint request for a 2-level downward variance due to the anticipated guideline amendment for defendants with no criminal history points. Sentence was imposed. Government had no objections to Defendant remaining on bond pending voluntary surrender. The Court will make a recommendation to the BOP regarding Defendant’s Case 1:22-cr-00284-SEG-CMS Document 34 Filed 06/08/23 Page 1 of 2 placement. Defendant was informed of her appeal rights.
