We are happy to provide the 404(b) notice now, even though the counts are still pending.
Accordingly:
If, Crowther pleads to counts five and six, we intend to introduce evidence that Crowther
made materially false representations to Angel Oak Mortgage Solutions, LLC to secure a
mortgage loan from that entity, namely providing inflated bank account statements in
connection with the application process. The evidence would be introduced to prove intent,
knowledge, and absence of mistake in the context of Counts One and Two of the Second
Superseding Indictment.
