I, SHAWN M. KENNEDY, hereby declare as follows: 
1. 
I am a partner of the law firm of Herrera Purdy LLP (“HP”), co-counsel for 
plaintiffs James Cottle and Frederick Schoeneman (together, “Plaintiffs”) in the above-captioned 
action. I am a member in good standing of the Bar of the State of California and am admitted to 
practice before this Court. I have personal knowledge of the statements contained in this 
declaration and, if called to testify, I could and would testify competently to them. I submit this 
declaration in support of the Plaintiffs’ Administrative Motion to Continue Case Management 
Conference.

On July 17, 2020, the parties to this action joined with all parties to the related 
actions of Mitchell v. Plaid Inc., 3:20-cv-04230-SK, Curtis, et al. v. Plaid Inc., 4:20-cv-04344-
DMR, and Anderson, et al. v Plaid Inc., 3:20-cv-04480-JSC, to jointly file a stipulation 
requesting that the Court consolidate those actions under Federal Rule of Civil Procedure 42(a), 
and to appoint interim class counsel (the “Stipulation”).

On July 24, I reached out to counsel for defendant Plaid Inc. (“Plaid”) and 
requested that Plaid agree to continue the Initial Case Management Conference until 30 days after 
the Court rules on the Stipulation. Plaid declined on the basis that it would only agree to a 
continuance until a date after the Court ruled on a motion to dismiss.
