ORDER 
 
At Charleston, on July 23, 2025, came the United States by Amy McLaughlin, Assistant 
United States Attorney, and the Defendant, Malik Breckenridge, who appeared in person and in 
custody, represented by court-appointed counsel, John Balenovich, CJA Panel Attorney, for a 
Preliminary Hearing on Petition for Warrant or Summons for Offender Under Supervision. 
Also present was Mark Ruscello, United States Probation Officer. 
 
The Defendant executed a written Waiver of Preliminary Hearing which was witnessed 
by defense counsel and made part of the record.  Accordingly, the Court found probable cause to 
believe that the Defendant violated the conditions of supervision as alleged in the Petition.  The 
Defendant shall next appear for the Revocation Hearing before United States District Judge Irene 
Berger on July 30, 2025, at 11:00 a.m. 
The Defendant made an oral motion for the Defendant’s release on bond/GPS monitoring. 
Following proffers and arguments of counsel, the Court DENIED said oral motion. Therefore, it is hereby 
ORDERED that the Defendant is remanded to the custody of the United States Marshals pending 
said Revocation Hearing.

The Court DIRECTS the Clerk to provide a copy of this Order to the Assistant United 
States Attorney; to the Defendant and his counsel; to the United States Probation Office; and to 
the Office of the United States Marshal.
