that I understand that our colleagues have 
been meeting and conferring about , that's also 
not a basis for keeping the deposition open. 
As we stated in our privilege logs and stated 
again this week during those meet and confers, 
our position i s that those documents are 
protected by attorney-client privilege.

plaintiffs have known about those documents 
for .seven to 12 months . 
They were l ogged in 
February, April, and June. 
If plaintiffs had a dispute wit h our 
privilege claims 1 they could have brought that 
issue to Judge Berg months ago.
