Do you recall that?

of hardware that connects to a network?

Yes.

Fair to say that a router is a common piece of
hardware that connects to a network?

And the practical effect of that is that it might
appear to someone else that you are accessing the
internet from a different geographical location than
where you are actually sitting?

Yes.

Now, we are going to show you an exhibit that's in
evidence.  And I will just represent it is a loan
application, but we are not going to ask him about the
loan application, just the IP addresses as an
illustrative example.
Okay.  So let's go ahead and pull up
Government Exhibit 2H.
So we have got here Exhibit 2H.  It is a loan
application.  And like I said, I am not actually going to
ask you about the application itself.
So we can go to page 35.
And here on page 35, part of this application
appears to be a log of access to the website where the
application is submitted.  Do you see this here?

Yes.

column towards the bottom of the page.  You see where it 
says IP address 1043475188?

Yes.

Okay.  So using this as an example, you agree that
the IP address consists of four numbers, and they are
separated by dots?
A
Yes.

And would you agree that the first two numbers of
any given IP address like this one are the network part
where they identify what network this device is connected
to?
A
The first two sets -- I am unsure.  I would have to
go back to my notes to make sure exactly what each part
of the IP address correlates to.
Q
Would you agree, though, that the IP address gives
us information about both the network that this device is
connected to as well as the host or the specific devices
that's on a network?
A
It can.  Yes.
Q
So if devices are on the same network, say we have
got two routers here in the courtroom, they might share
similar parts of the IP address because they are on the
same network but they are not going to have the same IP

address because each is a separate piece of hardware?
THE COURT:  What do you mean by host?  Ask him
that question.
Q    BY MR. KEOUGH:  Do you understand what I mean by  
host when I say the host network? 
A
Yes.
THE COURT:  Tell the jury.
Q    BY MR. KEOUGH:  can you tell the jury? 
A
Well, the host is what is -- can you ask me the
host in the question again?
Q
Sure.  So it is fair to say that the IP address
contains information about the host network or the larger
network that this device is connected to?
A
Yes.  So the host in this case in a sense would be
like the router from your house, and I think what you
mean is different devices within the household could have
have different IP addresses.  It is not completely true.
For the most part, the house will have one address and
you can have subsets, a subnet.
Q
And my apologies because I think my question was a
little confusing.  I am not asking about devices within
the home simply the connection point to the network, the
router itself.
So you would agree that the IP address of the
router tells us both information about the router as well

to connect to the Internet?

From my understanding, the Internet provider will
provide your household or each user one IP address.
Q
And if you could just tell the jury briefly what a
router is just to make sure we are all on the same page.
A
A router is just the way for the Internet provider
to connect you from their service to your like wi-fi.
Your wi-fi device would be considered a router.  It will
distribute that Internet access to the devices in your
house.

Now, looking at this IP address again, the example
here that we have highlighted, 1043475188, just from
looking at the IP address itself can we tell whether this
IP address is associated with a VPN network?
A
No, you cannot tell.

We would need more information to do that?
A
Yes.

And, for example, if the VPN service had a
subscriber record that might be helpful to determine what
network this IP address is associated with?
A
Yes.

And as part of your investigation in this case,
were you asked to pull any subscriber records for a VPN
network to determine whether certain IP addresses might

for a new device, are you able to use iCloud backup to
restore the information on your old device to the new
device?

Now, what is an MD5 hash value?

MD5 hash value is essentially, like I explained
last week, is the digital fingerprint of a particular
file.

And that file can be an image; right?
A
Yes.

And iCloud backs up images from iPhones; right?

Let's say I take a photograph of an old device.
That is going to be backed up to the iCloud for that
device so long as there is an Apple ID associated with

So iCloud can tell you when an image was first

A
They are a Utah -- an FDIC-insured industrial bank

your responsibilities at Celtic Bank?
A
I am the bank Secrecy Act officer.  It is my job to
oversee and implement controls to detect and report
potentially suspicious activity.

And are you familiar with customers of that bank,
with Celtic Bank?
A
Yes.  We work primarily with small businesses.
Q
And are you familiar with the type of services that
Celtic Bank offers to its small business customer
measures?
A
We primarily engage in commercial lending.  We
issue small business administrative loans.

Are you familiar, Mr. Masterman, with the term SBA
lender or SBA-approved lender?
A
Yes.

What does that term mean?
A
To issue loans on behalf of the Small Business
Administration, or the SBA, a lender needs to apply for a
license and have this agency of the federal government
approve that lender.
So essentially Celtic Bank applies for a
lending license to issue SBA loans and the SBA comes in
and kind of does an approval process.

COVID-19 pandemic to continue paying their employees.

applying for a PPP loan, could that customer apply

request from the borrowers?
A
The SBA.

So this type of information was required uniformly
across SBA-approved lenders?
A
Correct.

Now, is it important to Celtic Bank that applicants
provide truthful and accurate information in their
applications?
A
Yes.

Why is it important?  
A
Because according to the rules of the PPP program,
lenders were allowed to rely on borrower attestations
that the information submitted with their application
were true and accurate.
Submitting false information would potentially
take away from the pool of funds that the SBA provided
specifically for this program.

that was designed by the SBA.

Directing your attention to the top of the page,
what is the significance of the number of employees to
this application?
A
Generally speaking, because this program was
designed for employers to pay their employees, the more
employees a company had, the chances ever a higher loan

Well, you know, we rely on a program to collect the

program was able to get.  And then that data, there is a
hash.  It is kind of like what we call a digital
fingerprint.  So the data that is in the extraction at
the end gets hashed, and it is basically a mathematical
output of an algorithm.

So it is possible that hash data does not include
all of the data that was on the phone?

number ending in the last four digits of 9924, was used
to submit an application in the business name of Fiber
One Media on or about June 17th, 2020.  That application
was submitted to WebBank and the approximate application
amount was $276,652.
That loan was canceled, and the government
exhibit number is 3G.
