MS. AHN: Good afternoon, your Honor. Catherine
Ahn here with DOJ trial attorney Christopher Fenton,
AUSAs Dan Boyle, Scott Paetty and Brian Faerstein.
MR. MESEREAU: Good afternoon, your Honor. Tom
Mesereau representing Artur Ayvazyan who is present.
MS. WIRSCHING: Good afternoon, your Honor.
Jennifer Wirsching also representing Artur Ayvazyan who
is present and out of custody.
THE COURT: Okay. This is the time for
sentencing. Has the defendant read the presentence
report?
MS. WIRSCHING: Yes.
THE COURT: Then, as I have discussed with the
other sentencing this is morning or this afternoon in
this case, the first issue is to assess the guidelines.
My inclination is to find a guideline range of 27 with a
criminal history of 1 based upon 23 for loss plus 2 for

sophisticated means and plus 2 for the money laundering
conviction. That is my inclination, but I will hear from
you if you wish.
MS. WIRSCHING: Yes, your Honor. With the Court's
permission for medical reasons, may I remain seated?
THE COURT: Yes, you may.
MS. WIRSCHING: I'm sorry, your Honor. As far as
the loss amount, what was the loss amount?
THE COURT: The loss amount as I computed with the
other conspirators was base offense level of 7, then plus
16 for 1.5 or more which is the most charitable analysis
the defense can get, and then I have, starting with 23,
added plus 2 for sophisticated means to get to 25, and
then plus 2 for the conviction under 1956, the money
laundering, which gets to 27, criminal history of 1 which
I think is 70 to 87 months; is that right?
MS. AHN: Yes, that's correct, your Honor.
THE COURT: That is the starting point at least as
I see it now, but I will hear from you if you wish.
MS. WIRSCHING: Thank you, your Honor. I would
just like to then briefly touch on a possible mitigating
role, and I understand the Court has read our filings and
our arguments on that so I will be brief. I would just
like to focus on the fact that, as the Court said, it may
be slightly difficult to compare the relative culpability

of people in this conspiracy.
Although, I would point out that Artur
Ayvazyan, much differently than most of these people who
have received higher sentences, there aren't -- there are
indicators, in fact, that he had a much lesser role.
There aren't e-mails between him and other participants.
There aren't text messages between him and other
participants. There isn't a lot of money going in his
accounts that wasn't from his legitimate business.
He doesn't seem to have any planning or
organization, and, as to relative culpability, again, if
the government is saying the loss is somewhere around
16 million, and I understand the Court is limiting it
here to more than 1, the actual conduct of the loans to
his business Allstate Towing and Transport were much,
much less than that.
So, in comparison to someone, say, like Manuk
Grigoryan, who was actively using multiple synthetic
identities, who had false and fictitious names on the
lease to his apartment to facilitate the fraud who had
filed over 19 loans.
In comparison to people like that, not to
mention obviously Richard Ayvazyan, I believe that a
minimal role for Mr. Artur Ayvazyan would be appropriate.
THE COURT: All right. I mean, I have considered

that, and, in the course of considering it, I looked at
some of the case law. I don't believe under the case law
and the guidelines themselves that this is an appropriate
case for a mitigation adjustment, nor do I think a minor
role adjustment is appropriate.
I did read a case called United States versus
B and M Farms, 87 F.2d, 1323, Ninth Circuit, 1996. It
might be F.3d. I don't -- maybe it is F.3d 1323, 1996.
I don't remember. And that case is somewhat instructive
in my thinking that the mitigating role is not
appropriate here. But some of the other things you said
are very relevant in terms of the sentencing factors.
So I am going to conclude by saying that the
guideline range is 27, criminal history of 1, 70 to 87
months as the guidelines starting point. But, now, I am
segueing to the 3553(a) factors, and I will be happy to
hear your arguments. You made some of them, but you can
make others or the same arguments with greater detail.
It is your opportunity.
MS. WIRSCHING: Thank you, your Honor.
And we do, as we stated in our filings,
believe a total sentence of 36 months would be
appropriate for Mr. Ayvazyan, that being a year on the
underlying offense and the mandatory 24 months
consecutive for the aggravated identity theft conviction.

There are two -- there are two parts to our
argument here for 3553: One of them is relative
culpability and sentencing disparity argument which I
have touched on briefly.
I have included in my filing just a brief
chart showing that as sentences have come down, people
such as Manuk Grigoryan who obviously were very involved
in the case, he did take a plea, but he received a
sentence of 72 months. Mr. Paronyan who, even if you
look at just his direct loans that he filed himself, had
three.
Our argument is that Mr. Artur Ayvazyan is
different -- is a little bit more like Vahe Dadyan in the
sense that he has two loans filed by his wife. They were
in his own name. They were in his own business, his
legitimate business name. He didn't receive a lot of
money from that. He has never owned a home. He didn't
own the home he was living in. He didn't have gold coins
and watches and all of these trappings, trips to Europe,
credit cards, synthetic identity credit cards, any of
these things in his home.
As far as character goes, I think I am sure
the Court read the numerous amount of character letters
we submitted. Mr. Ayvazyan, Artur Ayvazyan's character
shows through greatly in many circumstances. He was

raised until he was 9 years old in Armenia. He was
present there during the catastrophic earthquake that
killed 60,000 people. He came here to America with his
mother. He was greatly bullied for not understanding
English, for not fitting in and, quote, being different.
At a very young age of 14, his mother
shattered her ankle and was unable to work again. Artur
Ayvazyan, at the age of 14, then began working. He
passed out fliers. He worked at a pizza parlor making
boxes. He worked at a movie theater. This speaks to his
character.
This is the kind of person that says I need to
help my family, I will do whatever job is available to me
and I am not too proud do this hard work. When he was in
high school, he dropped out of high school to full time
support his mother. And he did. He has consistently
worked and been a hard-working person his entire life.
He has spent many years, as we have discussed
and this was heard at trial, running his own legitimate
trucking business, Allstate Towing and Trucking. He ran
his own trucks. He drove his trucks. He provided a
service to the community, driving goods up and down the
coast delivering them to the community even at the
expense of being close to his family, his two children
which are his life.

His children, as I said, and as I am sure you
see in the character letters that they have written, his
children rely on Mr. Ayvazyan for not just financial
support of a dad, but he literally is, as one of his
child states, their best friend. He is the one who shows
up at their recitals and films their dance routines. He
is the one who talks to them when they are having
boyfriend problems. He is the one who drives them to
school. He is the one who takes them and helps them and
cares for them.
And not just his own children. This extends
to his nieces and nephews as I am sure you have seen in
the character letters. Character letters were provided
in this case by Richard Ayvazyan and Marietta
Terabelian's children as to their uncle, Artur Ayvazyan.
They almost without exception describe him as
a second father. They describe him as a loving, joyful
man who didn't show his problems but was there to help
them, to teach them to ice skate. One child said helped
her get over her fear of being in the ocean, and one of
Richard and Mary's children laments, my uncle Art cares
too much about my school, he bugs me, he calls me, did
you go to school, did you finish your assignments. And
he says in his letter that helps him want to do better in
school because it is so important to his uncle, Artur

Ayvazyan.
Which leads me to a final statement I will
make about his character, and I included a declaration
about this in my sentencing memorandum. And I think we
can all agree that in times of crisis is when character
shows through.
In this case, it has been alleged that
Marietta Terabelian and Richard Ayvazyan absconded.
Whether they have absconded or been taken, they are gone.
On the night that they disappeared, Artur Ayvazyan was
contacted not by his pretrial services officer but by
Richard Ayvazyan's pretrial services officer. This
pretrial services officer contacted Artur Ayvazyan and
said, paraphrasing, said your sister-in-law Marietta
Terabelian's ankle monitor has not been tampered with but
it is not moving, I think she may be severely injured or
dead.
Now, most people in a situation like that, a
man who has been convicted at trial who is facing a huge
amount of prison time would think what do I do to save my
own butt, I need to call my attorneys, what should I do,
how should I respond, this isn't my pretrial services
officer, what should I do.
Instead of doing that, without having a single
thought for himself, Artur Ayvazyan threw on shoes, got

in his car, drove to the address that that probation
officer gave him and asked the people there if they had
seen Marietta Terabelian, showed them photographs, if you
see her, can you please contact me. Upon not being able
to find his sister-in-law, he then drove to Richard
Ayvazyan's and Marietta Terabelian's home to make sure
that everything was okay.
What he found there were her three children,
his niece and two nephews alone and frightened. Without
calling his lawyers to see if this was okay, without
contacting his personal probation officer to see if this
was okay, he took those children back to his home to care
for them.
This is the type of of man who under crisis
thinks of others. He didn't think could this hurt me, am
I going to get reported for being out of my home when my
ankle monitor says I'm not supposed to be. He went to
see if he could provide aid to his sister-in-law, and,
finding those children alone, he brought them home to
care for them.
So that is the character of the man who is
being sentenced today, and I think that sets him apart
from some of the other people that have come before you
in this case, your Honor. Richard Ayvazyan has been
described as a serial, inveterate fraudster, and that he

may be. But Artur Ayvazyan may be his brother, but he is
nothing like him in character.
And I like to think that is one of the reasons
that 3553 exists is so that, if there are breaks to be
given, if there are chances to be meted out, they should
be to kind people. They should be to people who care
about others and do things selflessly. And that is the
character of Artur Ayvazyan.
And, for that reason, we would respectfully
ask the Court to vary downwards and give a sentence, a
total sentence of 36 months inclusive of the aggravated
identity theft.
THE COURT: Okay. Thank you.
I will hear from the government briefly.
MS. AHN: Yes, your Honor.
The defense counsel's representation is
contradicted even by the jury's own verdict which found
defendant guilty of aggravated identity theft with
respect to Anna Zukeva. On his phone, he possessed
numerous fraudulent IDs, numerous debit cards in other
people's names. He actually possessed confirmations of
PPP and EIDL loan applications including the ones he
purportedly didn't see as well as others used in the
fraud.
His role was to assist in the creation of

fraudulent IDs and, as indicated in the excerpts from
Government Exhibit 10 attached to the government's
position, to help create checks, to help transfer money
and receive money.
THE COURT: Let me inquire further on that.
My -- these are the findings I have, but I
need some more input perhaps from both sides on this. My
conclusion is that he lied when he testified. I do
believe that his testimony was patently incredible, and
the story about not knowing what was in the house I find
incredible. I find that he did know what was in the
house, the so-called room that his wife Tamara occupied
solely.
It is a matter of credibility, but, at her
plea, I specifically asked her whether the marriage was
intact because to some extent in her guilty plea under
oath, under oath, she implicated her husband which
sounded something to me that ought to be further inquired
into. And I asked her whether the marriage was intact.
She said it was. He said that he was there solely for
the children and living in another part of the house.
His story about how the false identities got
on his phone seemed totally implausible to me. Even with
regard to the proceeds of the loan, when he said that the
transfer of a good part of it to his brother was to repay

some unspecified loan in the past, there was no evidence
that his brother was pressing him for it or that he had
to get a PPP loan to pay it. And a chunk of that loan
was also used to buy I think a motorcycle.
MS. AHN: Yes, your Honor.
THE COURT: And so, essentially, he perjured
himself in my view. This is not to say he didn't have a
right to testify. Certainly, he did. He was the only
defendant who did. And testifying alone is not
necessarily a point in your favor. It is what you say or
don't say. But, understanding all of that, I am taking
all of that into account, what you started to say, I
didn't remember. That is that he created false documents
and so forth.
I also remember this: That in the phone log
between Tamara Dadyan and Richard Ayvazyan, she, the
wife, was saying Arthur wants his money. So there was
some hold up on getting him his money for the fraudulent
loan he participated in.
And then later on in the transcript or maybe
in another transcript, there is some conversation about
does Arthur want to do another one. And I am aware of
all these things, but what I am trying to digest and
intelligently decide is beyond what I have said -- and
that certainly implies that he knew the scope of the

conspiracy, knew that false identifications were made and
so forth, and got himself involved with the false loan,
but when you say he did something else more than what I
have just said, what is it?
MS. AHN: Yes, your Honor. Just a quick point of
clarification. I believe when you were referencing that
Arthur wants his money, I believe it was Vahe.
THE COURT: But there was the conversation about
Arthur wanting to do another one.
MS. AHN: Yes, your Honor. There was a
conversation I believe on page 1 or 2 of Government
Exhibit 10 saying Art wants to do one with US Bank which
I believe is one of his bank accounts, and, then,
furthermore, Mr. Ayvazyan was involved with the attempts
to provide Mr. Vahe Dadyan the money because if the Court
recalled, it was difficult to wire Mr. Vahe Dadyan the
money, so there was numerous times when they talked about
Art or Mr. Arthur Ayvazyan depositing a check on behalf
of Vahe.
THE COURT: Okay. I do have a memory of that now,
but that goes to his knowingly participating in the
fraud. But there is a lot of stuff going on here which
needs to be better defined. In other words, there are
these false identifications on his phone. I do attribute
what was found in the house to him given my overall

assessments of his credibility.
But what else is there? It seemed to me that
his participation in this was markedly different than
Richard Ayvazyan and Tamara Dadyan.
MS. AHN: Yes, your Honor. I believe -- so the
government requested a plus 4 for Mr. Richard Ayvazyan, a
plus 3 for Ms. Tamara Dadyan on behalf of their roles.
We did not request one for Mr. Arthur Ayvazyan. And that
is because when we review Government Exhibit 10, it
appears as if Mr. Arthur Ayvazyan is mainly assisting
Ms. Tamara Dadyan and Richard Ayvazyan in the fraud.
THE COURT: That seems to be what he did and
additionally make the loan from his -- for his company.
What was the name of the trucking company again?
MS. AHN: Allstate Towing and Transport, your
Honor.
THE COURT: But what is being argued, you know, in
terms of what he is as a person is relevant. I mean,
that is part of the sentencing factors. And I mean I
don't know any of these defendants more than what I heard
in Court, but it does seem that there is a side of him
that certainly is sensitive and different than what he
did here. Of course, he is being -- he is on trial --
being sentenced for what he did here. This is not an
assessment of his total life. Although, his life is a

factor.
So is there something I am missing or -- that
is his role.
MS. AHN: Yes, your Honor. We believe that his
role was to assist in the creation of fraudulent IDs and
checks.
THE COURT: What is the evidence of that?
MS. AHN: So in Government Exhibit, I believe 24A
or B, your Honor, it is cited in the government's
sentencing position, there were two handwritten notes
included in the last four pages of that exhibit. And in
those notes, it was for I believe Tony Glib and
Nercese -- I am going to butcher this name, but the last
name starting with N. And, in those notes, it directed
the creation of a fraudulent California driver's license
with specific address and other personal identification
numbers, and the matching California driver's license to
those notes was found in Mr. Ayvazyan's phone.
THE COURT: Say that again so I better understand
it. Are you saying that there was some handwritten
instruction?
MS. AHN: Yes, your Honor. There were two
handwritten notes included amongst the government's trial
exhibits.
THE COURT: Where were they found, on his phone?

MS. AHN: Yes, your Honor. Along with software
from a company called ID Now that had templates.
THE COURT: They were -- they didn't have any
other indicia other than being on his phone; correct?
MS. AHN: I'm sorry?
THE COURT: They didn't have any other indicia
other than their being found on his phone?
MS. AHN: I actually believe he was being
instructed by another individual based upon the
handwriting to create those IDs, your Honor.
THE COURT: To create those IDs.
MS. AHN: The fraudulent California driver's
licenses.
THE COURT: When you say creating, how did he
create it, by applying for it in those names?
MS. AHN: No, your Honor. Based upon the
templates for identifications found on his phone, it is
our belief that he created them using software of some
sort.
THE COURT: I see.
MS. AHN: And there is matching text messages in
Government Exhibit 10 where with respect to the creation
of checks, Tamara Dadyan asks Richard Ayvazyan where she
can get some checks. In return, Richard Ayvazyan
instructs her to tell Art to go to Office Depot and buy

the software for every bank so that they can create
images of checks which we believe were used in the PPP
and EIDL applications.
THE COURT: I see. All right. Do you wish to
respond to that?
MS. WIRSCHING: Yes, your Honor.
I would like to focus on Ms. Ahn's words here:
I believe, we believe, the government's theory is. This
was all so attenuated and so amorphous. Whose
handwriting is in these notes.
THE COURT: But it is found on his phone.
MS. WIRSCHING: A photograph.
THE COURT: Well, whatever is found on his phone,
my finding as a starting point is that it wasn't as he
testified that he had someone else put it there or he
loaned his phone to Tamara and somehow it got on there.
I just don't find that credible.
MS. WIRSCHING: I understand your finding, your
Honor.
My point being that if you are not finding
that credible, that is different than the government
saying we believe he was creating false checks. There
is --
THE COURT: Well, what about the evidence the
government just mentioned that there are text messages

where Richard Ayvazyan is telling Tamara, have Art go to
Office Depot or some place and get these -- I don't even
know what it is, some sort of device to make checks.
MS. WIRSCHING: I don't know, your Honor. That is
part of my point is that there is so much speculation
about all these things. I don't think it meets any kind
of burden showing, number one, that Arthur was involved.
Someone could send a text message about me to my
cocounsel, Tom, saying tell Jennifer, X, Y, Z. I may not
ever know that. He may be referring to another Jennifer.
THE COURT: But, then, the point the government
was making that in addition to the text message, lo and
behold, what he was asked to do was found on his phone.
Wasn't that your point?
MS. AHN: The information on his phone, your
Honor, yes. We did find checks on his phone associated
with identities used in the --

that nothing that Ms. Ahn presented here shows that Artur
Ayvazyan had check printing devices or check printing
software. She is saying they said he should get checks.
That was my initial point.
THE COURT: I see. I didn't hear anything about
devices. I heard and read what I was presented with.

am in a position to impose sentence.

THE COURT: Okay.
Pursuant to the Sentencing Reform Act of 1984,
it is the judgment of the court that defendant Arthur
Ayvazyan is hereby committed on Counts 1 through 20, 24
and 26 of the first superseding indictment to the custody
of the Bureau of Prisons for a term of 36 months.
This term consists of 36 months on each of
Counts 1 through 20 and 26 of the first superseding
indictment all to be served concurrently with each other
and 24 months on Count 4 of the first superseding
indictment to be served consecutively to Counts 1 through
20 and 26. That is a total sentence of 60 months.
Upon release from imprisonment, defendant
shall be placed on supervised release for a term of five
years. This term consists of five years on each of
Counts 1 through 20, three years on Count 26 and one year
on Count 24 all such terms to run concurrently under the
following terms:
One, he comply with the rules and regulations
of the United States Probation and Pretrial Services
Office and Second Amended General Order 20-04;
That he -- he is not a citizen. He is a
lawful resident; is that right?

impose that.
He shall not obtain or possess any form of
identification other than that in his true legal name.
He shall apply all monies received from income tax
refunds, lottery winnings, inheritances, judgments and
other financial gains to the court-ordered financial
obligation;
He shall submit his person, property, house,
residence, vehicle, papers, computers, cell phones, other
electronic communications or data storage devices or
media, e-mail accounts, social media accounts, cloud
storage accounts or other areas under his control to a
search conducted by a United States Probation Officer or
law enforcement officer. Failure to submit to a search
may be grounds for revocation;
Defendant shall warn any other occupants that
the premises may be subject to searches pursuant to this
condition;
Any search pursuant to this condition will be
conducted at a reasonable time in a reasonable manner
upon reasonable suspicion that defendant has violated a
condition of his supervision and that the areas to be

searched contained evidence of this violation;
He shall cooperate in the collection of a DNA
sample.
I have considered, in addition to the
guidelines -- and this sentence is somewhat beneath the
guidelines -- the sentencing factors under 3553(a). As I
have said, the fraud here was horrific and calculated and
calloused and resulted in losses to a very vulnerable
program imposed at a critical time in the country's
history.
The sentence is necessary to reflect the
seriousness of the offense, to promote respect for the
law and to provide just punishment, to provide adequate
deterrence to this defendant -- and I think the sentence
does -- to protect the public from further crimes of this
defendant.
I have considered other sentences available,
and I have considered the question of whether there are
sentencing disparities in other cases. As I have said
before, that is one consideration. There may be
differences in other cases, but it is hard to determine
whether they are precisely like this case and,
furthermore, judges have discretion to impose the most
lenient sentence necessary in their discretion, and that
is what I think I am doing.

This defendant helped perpetuate the fraud.
He wasn't an architect. He may not have been critical,
but he was involved and not just in a passing way. And
the sentence is justified for the reasons I have just
said and for the other reasons I have mentioned in the
course of the discussion.
Bond will be forfeited upon surrender. He is
ordered to pay a special assessment of $2200. I am
ordering restitution. Can we have the same understanding
I have with the other defendants about having to adjust
the restitution amount and before we finalize the
judgment, Ms. Wirsching?
MS. WIRSCHING: Yes, your Honor.
THE COURT: Yes.
And I won't order the terms of restitution
repayment until we know an amount.
I guess that is it; right?
MS. AHN: Your Honor, we actually would like to
request remand based upon the most recent filing and
provision of information from pretrial services
recommending immediate remand, your Honor.
THE COURT: Well, let me examine that. I read the
report also, and he is -- there is a violation of
pretrial services by just being arrested?
MS. AHN: It is not just the arrest, your Honor.

It is also the underlying conduct that raises --
THE COURT: How does the Court determine what the
underlying conduct is? I read the report. I mean that
is what trials are about. I assume he hasn't plead
guilty to that. He is going to contest the charges. I
don't know what happened. I read the account of the
victim, and I mean how can I assess whether she was
truthful or not? I don't know. It seems like, from what
she said, there was some prior conduct which may be a
factor in whatever he was charged with. I don't know. I
can't make any assessment. I can't remand him on that
basis.
MS. AHN: No, your Honor. And my apologies. I
may have been unclear. We are not seeking at this time a
finding of whether or not he violated pretrial release
and on that basis remanding defendant. We are requesting
remand of defendant based upon the factors that the Court
may always consider at this time whether or not he should
remain on bond pending further information.
This Court has the authority to revoke bond if
it determines that the defendant presents a risk of
nonappearance or a danger to the community separate and
apart from a finding of a violation.
THE COURT: I understand that, but what is
different now than what I decided previously? Yes, he

has been sentenced, but he knew he was going to be
sentenced. I mean, he didn't come here thinking, based
upon the record here, that he would get a probationary
sentence. Even his counsel didn't seek that.
And the sentence may have been more than what
was requested by the defense, but it -- it was in the
neighborhood. And he is here. And he has bond in the
state rape, forcible rape case. He has been on bond in
the pending mortgage fraud case. He has a lot of stuff
ahead of him, and I would think if he is going to flee
that he would flee before all this.
He has got a lot of obstacles before him. I
don't see it. I can't consider the fact that his brother
and his sister-in-law did what they did. I mean, they
are different people, different circumstance. He has
made all his appearances.
Other than what he has done in this case, as
Ms. Wirsching outlined, he seems to have a love of
family. So I don't know. I have to be more convinced.
MS. AHN: Well, your Honor has addressed risk of
nonappearance but one of the very alarming things about
the arrests, your Honor, is the danger to the community
factor, your Honor.
THE COURT: In what sense? That he is going to
rape other women?

MS. AHN: Well, according to the arrest report, he
not only committed that rape, that is the allegation, he
had done it three times before, and the instance for
which he was arrested he did it while there were children
in the house. This idea, the allegation that the
defendant not only presents a risk of danger to the
community based upon fraud which was the concern before
has now been enhanced that he is a danger to the
community based upon violent crime.
THE COURT: I am not going to make that finding at
this point, but I am going to order him to self surrender
by first week in January.
MS. WIRSCHING: Thank you, your Honor. May I just
make one point of clarification?
THE COURT: Yes.
MS. WIRSCHING: Just to make a point of
clarification on the order to show cause. There is no
case. This case is not a filed case. It is merely an
arrest. It is merely an allegation. It is not a filed
case.
THE COURT: I didn't know that. I assumed, maybe
improperly, that it was a case. All I had before me was
the police report.
MS. WIRSCHING: Understood. And we appreciate the
Court allowing self surrender after the Christmas

so that he can remain near his family.

presentence report that tells you what his financial
condition is, and, according to this, he has assets of --
according to this he has a minus net worth of $728,811;
is that right?
MS. AHN: Yes, your Honor. As noted in the
presentence report and in the most recent provision from
the pretrial services, they are unclear what the source
of funds for his monthly expenses are.
THE COURT: Well, you know, I can't do an
