In accordance with the orders filed during the pendency of this case, and pursuant to
Fed. R. Civ. P. 58(a), the following Final Judgment is hereby entered.
Pursuant to the Order of United States District Judge Regina M. Rodriguez entered
on September 2, 2025 [ECF No. 50] it is
ORDERED that the Recommendation of the United States Magistrate Judge [ECF No.
121] is ACCEPTED and ADOPTED. It is
ORDERED that the State Defendants’ Motion to Dismiss Amended Complaint [ECF No.
33] is GRANTED as follows:
• Plaintiff’s claims against the Division of Unemployment Insurance are DISMISSED
WITHOUT PREJUDICE pursuant to Fed.R.Civ.P. 12(b)(1) for lack of subject
matter jurisdiction;
• Plaintiff’s official-capacity claims against all individual Defendants are DISMISSED
WITHOUT PREJUDICE pursuant to Fed.R.Civ.P. 12(b)(1) for lack of subject
matter jurisdiction;

• Plaintiff’s individual-capacity claims against Defendants Barela and Fitzgerald are
DISMISSED WITH PREJUDICE;
• Plaintiff’s ADA claim is DISMISSED WITHOUT PREJUDICE;
• Plaintiff’s remaining claims are DISMISSED WITHOUT PREJUDICE.
FURTHER ORDERED that judgment is entered in favor of the Defendants and against
the Plaintiff.
This case will be closed.
