AND NOW, this 21st day of May, 2024, upon consideration of Dave Inc.’s Letter Request (ECF 
No. 115) and the Declaration at Exhibit A attached thereto, IT IS HEREBY ORDERED that the 
Letter Request (ECF No. 115) is APPROVED and Dave Inc. is excused from the May 23, 2024 
discovery hearing.1 
IT IS FURTHER ORDERED that Defendants shall provide a status update regarding all 
remaining third-party discovery by no later than Wednesday, May 22, 2024 at 9:00 am.2

1 The purpose of the May 23, 2024 discovery hearing is to better understand and resolve delays in 
this three year old case. Defendants have represented that third-party discovery is one source of 
these delays, so the Court will readily excuse any third-party custodian that has complied with its 
subpoena. 
 
2 In their May 10, 2024 letter, Defendants assured the Court that it would provide this update last 
week. The Court notes the unfortunate irony of Defendants’ delay in providing this update as the 
Court endeavors to resolve delays in this case.
