IN THE UNITED STATES DISTRICT COURT FOR THE SOUTHERN DISTRICT OF WEST VIRGINIA CHARLESTON DIVISION UNITED STATES OF AMERICA, PLAINTIFF, V. CASE NO.: 2:24-cr-00192 KISHA SUTTON, DEFENDANT. DEFENDANT KISHA SUTTON’S RESPONSE TO GOVERNMENT’S MOTION MOTION FOR JUDICIAL NOTICE NOW COMES the Defendant, Kisha Sutton, by and through counsel, and hereby responds to theGovernment’s Motion for Judicial Noticeby stating as follows: 1. DefendantSuttondoesnotobjecttotheCourttakingJudicialNoticeofthefactthat Huntington, Cabell County, West Virginia; Charleston, Kanawha County, West Virginia; and South Charleston, Kanawha County, West Virginia, are within the Southern District of West Virginia. However, Defendant Sutton does object tothe Court taking Judicial Notice that any alleged crime took place in those areas as there has been no evidence introduced to suggest the same. There is a pending Venuechallengeaddressingthisissue.Additionally,thisMotionissimplypremature and should be denied at this time. 2. Defendant Sutton objects to the Court taking Judicial Notice of any federal administrative rules applicable to the implementation of the Paycheck Protection Program atthistimebecausetheGovernmenthasnotsuggestedwhichversionof Case 2:24-cr-00192 Document 275 Filed 06/24/25 Page 1 of 3 PageID #: 1368 therulesitseekstooffer.ThePPPrulesandregulationswereamendedmanytimes throughout the Covid Pandemic. The government hasnotprovidedcontexttothe Court of which rules it seeks to judicial notice of inrelationtotheactsforwhich Ms. Sutton is accused of violating them. Admitting therulesinwholeatthispoint would deprive the Defendant of the opportunity to contest, at trial, that any particularrulewasinplaceatatimeMs.Suttonallegedlyacted.Thismattershould be left for trial consideration.
