SHEPPARD’S NOTICE ESTIMATING A SENTENCING  
HEARING OF THREE TO FOUR HOURS 
 
 
Sentencing is currently scheduled for June 7, 2024, fourteen days from now. 
By Paperless Order, this court directed that if more than thirty (30) minutes is needed 
for the sentencing hearing, counsel shall file a notice estimating the amount of time 
needed for the sentencing hearing no later than fourteen (14) calendar days prior to 
the hearing.” ECF#191 (01/16/2024).  
 
Undersigned estimates that at sentencing Sheppard will present two to three 
hours of legal argument, live testimony and exhibits to challenge the government’s 
proposed sentencing guidelines enhancements (including but not limited to the 
computation of loss) and to address the other factors under 18 U.S.C. section 3553.

Government counsel advised undersigned that the government estimates it 
may present one hours’ worth of evidence. However, the government may not be in 
a position to complete its presentation on the issue of restitution on June 7, 2024.  
 
Accordingly, undersigned suggests that the Court set aside four hours for the 
sentencing hearing on June 7, 2024, and additional time, if needed, for a restitution 
hearing within 90 days thereafter. See 18 U.S.C. section 3664(d)(5).
