NOTICE TRUSTEE’S MOTION FOR AUTHORIZATION
TO MAKE FIRST INTERIM DISTRIBUTION
NOTICE is hereby given by Aaron C. Amore Trustee in the above styled
matter who has applied to the Court for authority to make his Motion for First
Interim Distribution to 1) pay the approved fees and expenses of professional persons
employed by the Estate, 2) partially pay the Trustee’s commission from the sale of
real estate and approve for future payments from available funds received to pay the
commission in full, and 3) approve the payment to secured claims of West Virginia
Paving, LLC and Howard Shockey & Sons, Inc. as funds become available. The
payment of the Trustee’s commission and secured claims was approved by this Court
through its Corrected Order granting the Trustee’s Motion to Sell entered on July 16,
2021, at Doc 383.
YOU ARE FURTHER NOTIFIED that if you object to the
Motion/Application, you must file your written objection with the Clerk of
this Court on or before Twenty-Three (23) days from the date of this Notice.
If you object, you should provide an explanation for the basis of your objection.
If you are a business entity, any objection must be filed by an attorney. The Court, in
its discretion, may grant or deny the relief sought based on the written contents of
WKHDERYHïPHQWLRQHGGRFXPHQWDQGDQ\ILOHGREMHFWLRQ or, if an objection is filed,
may set the matter for hearing upon further notice by the Clerk to affected parties. A
failure to timely file a written objection may result in the entry of an order that grants
the relief sought in the document without further notice or hearing.
PLEASE TAKE NOTICE that the Court will conduct a hearing by Zoom
on December 1, 2021 at 3:00 PM to consider and act upon the following:

form of the proposed order annexed to the Motion, which may be entered with no
further notice or opportunity to be heard offered to any party.
