AMENDED ORDER GRANTING TRUSTEE’S MOTION FOR
AUTHORIZATION
TO MAKE FIRST INTERIM DISTRIBUTION
On a day prior came the Trustee, Aaron C. Amore with a Motion for
Authorization to Make the First Interim Distribution for administrative fees and
expenses incurred in the preservation of the estate and as by ordered by this Court.
The motion was served and noticed upon the creditor body and parties in interest
with objections due on or before November 19, 2021.
The Court being of the opinion that the Motion for the Trustee should be
granted. No objections have been filed.
Accordingly, it is;
ORDERED and ADJUDGED that the Trustee is authorized to make an
interim distribution to the pay the approved administrative fees and expenses as
follows:
Kelly T. Smith, of Smith, Elliot Kearns & Company, LLC in the amount of
$6,102.00.
John (“Jack”) P. Lantzy of Smith, Elliot Kearns & Company, LLC in the amount of

$23,437.50.
Aaron C. Amore, Trustee partial payment of allowed commission ($205,291.82) from
the sale of real property in the amount of $152,500.00.
It is further, ORDERED that the Trustee is authorized to make payments up
to the amount of his approved commission as outlined in the Motion for
Authorization to Make the First Interim Distribution, and further, to pay the
secured claims of West Virginia Paving, LLC in the approved amounts of $20,000.00
and Howard Shockey & Sons, Inc. $10,000.00 respectively, which have been
previously approved, as set forth in the Corrected Order entered 7/16/21, Doc 383a.
The Trustee will be required to file a notice of payment detailing the funds received
and the funds paid pursuant to this Order.
