Plaintiffs’ Motion for Class Certification and Defendant’s Opposition to the Motion, and based 
on all other proceedings in this litigation, the Court hereby ORDERS as follows: 
1.  Plaintiffs’ proposed Damages Class and Declaratory Judgment Class fail to meet the 
applicable requirements of Federal Rules of Civil Procedure 23(a), (b)(2), and (b)(3). 
2. The Motion for Class Certification is therefore DENIED.
