MOTION FOR A FINAL ORDER OF FORFEITURE 
 
 
The United States of America moves for a Final Order of Forfeiture for the following 
reasons: 
 
  1.  On June 27, 2024, this Court entered a Preliminary Order of Forfeiture for: (A) one 
Western Digital 1 GB My Book 1110 external drive; SN: WCAV5J746167; (B) one Toshiba 
Laptop Computer Satellite P75-A7200, SN: 8D040167C; (C) one SD Card; and (D) one 
Motorola Edge Plus 2022 cell phone, IMEI 356439690571575. DN 45.  The Court sentenced 
defendant Heath Gauthier on June 28, 2024, and the preliminary order of forfeiture then became 
final as to Defendant.  DN 47.  
 
2.  For potential third parties, the United States posted notice of this proceeding on an 
official government internet site (www.forfeiture.gov) for at least 30 consecutive days, beginning 
on July 2, 2024, pursuant to 21 U.S.C. § 853(n)(1) and Rule 32.2(b)(6)(A). No party filed a 
timely claim by the post-publication claim deadline of August 31, 2024. DN 52. 
 
3.  There are no known potential third-party claimants to the asset(s) listed in the 
preliminary order of forfeiture.  The deadline for filing all claims/petitions has elapsed. 
Accordingly, the court may enter a final order of forfeiture. See Rule 32.2(c)(2). 
 
4.   Therefore, the United States respectfully requests that this Court enter a Final Order 
of Forfeiture, forfeiting to the United States: : (A) one Western Digital 1 GB My Book 1110

external drive, SN: WCAV5J746167; (B) one Toshiba Laptop Computer Satellite P75-A7200, 
SN: 8D040167C; (C) one SD Card; and (D) one Motorola Edge Plus 2022 cell phone, IMEI 
356439690571575, pursuant to 21 U.S.C § 853, and ordering the Department of Homeland 
Security, the Department of Homeland Security Investigations, or any appropriate federal law 
enforcement agency, to dispose of the property in accordance with the  applicable law and
