How was the unemployment loss made up?

An email from the Assistant United States Attorney, filed December 6, 2024, states that the loss to Workforce West Virginia comprises a federal portion of $6,000 (ten weekly $600 Federal Pandemic Unemployment Compensation payments created by the CARES Act) and a state portion of $2,760 (ten $276 payments), a total unemployment compensation loss of $8,760.

How is the restitution to be paid?

The same email proposes that under 18 U.S.C. § 3664(i) the first restitution received go to Workforce West Virginia to satisfy the state portion, after which payments are split between the Small Business Administration and Workforce West Virginia. Defence counsel's email of December 6, 2024 agrees with that distribution, and the court ordered both emails filed.

What happened at the plea hearing?

Lomax waived his right to proceed on an indictment, the court read the single-count information, the government read the stipulation of facts, and Lomax explained the factual basis in his own words.
