AND SUPPORTING MEMORANDUM OF LAW 
 
 
The Defendant, DESMOND DONDRE WILLIAMS, by and through 
his undersigned attorney, files this Unopposed Motion to Continue Trial set for 
December 5, 2022, and states the following: 
1. 
On October 18, 2022, the Court scheduled this case for trial. 
2. 
Mr. Williams is on bond and is compliance with the conditions of 
his pretrial release. 
3. 
This case alleges a fraudulent Paycheck Protection Program loan.  
There is fairly extensive discovery including bank records, other 
paperwork, and recorded interviews.  The undersigned has met 
Mr. Williams regarding the case but needs additional time to 
completely review the records.  However, the undersigned counsel 
will be in trial the week of December 5, 2022, with Judge Howard 
in a case that has been long scheduled for that date. She is the 
only one familiar with this case and none of the other attorneys 
can be prepared to adequately represent Mr. Williams.

Additionally, the undersigned has scheduled leave, in addition to 
the upcoming holidays, that will limit the time available to review 
these matters.

Mr. Williams consents to this continuance. 
5. 
Kevin Frein, AUSA, indicates no opposition to this motion.    
6. 
This motion is not made for the purpose of unduly delaying the 
proceedings herein.  The trial has not been previously continued. 
MEMORANDUM OF LAW 
 
A continuance may be allowed by order of the Court for good cause 
shown.   See Local Rule 3.08.   
 
WHEREFORE, Mr. Williams requests that this Honorable Court 
continue the currently scheduled trial for (60) sixty days, resetting the trial to 
the February 2023 trial term.
