ORDER  
The Court held a status conference in the above matter on September 6, 2022, to address 
Defendant’s progress in treatment and to further address whether he financially qualified for 
appointed counsel. The Court first received an update from Defendant regarding his progress in 
treatment, which indicated that Defendant continued to make good progress.  
The Court then addressed the issue of Defendant’s assets. Defense counsel provided 
significant information regarding Defendant’s assets through schedules from Defendant’s prior 
bankruptcy filings and pleadings from Defendant’s divorce case. The United States Probation 
Office was provided the opportunity to ask questions of counsel about the status of certain assets 
which public records demonstrated Defendant might still own. After the proof was provided and 
the questions of the Probation Office addressed, the Court found that there was sufficient 
evidence to support Defendant’s contention that he accurately and fully disclosed his assets in 
the Financial Affidavit filed with the Court. That filing clearly demonstrates that Defendant 
financially qualifies for the appointment of counsel. As such, the Court finds it is appropriate for

Jefferson B. Fairchild, a member in good standing of the CJA panel, to continue to represent 
Defendant in future proceedings.
