CASE NO. 2:20-cr-114-JES-MRM CASEY DAVID CROWTHER UNITED STATES OF AMERICA’S RESPONSE TO MOTION FOR COURTROOM ACCESS FOR EXPERT WITNESS The United State of America responds to Defendant’s motion to permit his retained expert to sit in the courtroom during trial. Doc. 73. Crowther first disclosed to the government that he may call an expert witness in his defense shortly before motions in limine were due in this case. The government recently filed a motion seeking to prohibit that expert’s testimony and asking the court to deem the motion timely filed given the circumstances. Doc. 79. Considering, however, that the motion for access does not suggest that the individual will testify as a lay witness and relates only to courtroom access for that individual, it does not object to her presence in the courtroom to assist Crowther in the defense of his case.
