Brian Wiggins (“Plaintiff Wiggins”) in the Multi-District Litigation captioned In 
re:  Bank of America California Unemployment Benefits Litigation, Case No. 3:21-
MD-02992-GPC-MSB, Related Case No. 3:21-CV-01084-GPC-MSB through his 
undersigned counsel, stipulate and jointly move this Court for an order substituting 
Cotchett, Pitre & McCarthy, LLP as counsel of record in place of James V. Nolan 
of Gardner, Janes, Nakken, Hugo & Nolan. 
I. 
INTRODUCTION 
On February 2, 2021, Plaintiff Wiggins filed his initial case against 
Defendant Bank of America, N.A. in the U.S. District Court for the Eastern 
District of California (case no. 2:21-cv-00319-MCE-KJN). At that time, Plaintiff 
Wiggins’s was represented by James V. Nolan of Gardner, Janes, Nakken, Hugo & 
Nolan. On June 9, 2021, the Multi-District Litigation ordered Wiggins’s case to be 
transferred to the U.S. District Court for the Southern District of California and 
assigned to the Hon. Judge Larry Burns [See Dkt. 12 and 14]. On August 17, 2021, 
Cotchett, Pitre & McCarthy, LLP, and Altshuler Berzon LLP, Interim Co-Lead 
Counsel for Plaintiffs and the Proposed Class, filed the Master Consolidated 
Complaint in the In Re Bank of America California Unemployment Benefits 
Litigation Case No. 3:21-md-02992-LAB-MSB. At that time, Plaintiff Wiggins’s 
case was consolidated into the In Re Bank of America California Unemployment 
Benefits Litigation and he continued to be represented by James V. Nolan.  
At present, due to the professional retirement of James V. Nolan and the 
firm Gardner, Janes, Nakken, Hugo & Nolan, Plaintiff Wiggins requests to 
substitute Cotchett, Pitre & McCarthy, LLP as counsel of record.
