ORDER SETTING ENE SCHEDULING 
CONFERENCE  
 
At the Status Conference on July 19, 2021, counsel for certain individual plaintiffs 
indicated that many would like the opportunity to attempt to resolve their claims 
against Defendant at an Early Neutral Evaluation Conference (“ENE”) and counsel for 
Defendant expressed willingness to participate.  The Court SETS an informal, video ENE 
Scheduling Conference to discuss the format and scheduling of an ENE to address 
settlement of individual plaintiffs’ claims on August 2, 2021, at 11:00 a.m., via Judge 
Berg’s Zoom.gov account. 
Interim Liaison Counsel for Individual Plaintiffs and counsel for Defendant are 
ORDERED to attend.  Any other counsel for individual plaintiffs who would like to 
engage in early settlement negotiations should also attend.  No later than July 28, 2021, 
all counsel who plan to attend the ENE Scheduling Conference must email 
efile_berg@casd.uscourts.gov, indicating intent to participate and providing an email 
address for the Zoom invitation and a contact telephone number for the time of the
