years supervised release, $100.00 special assessment and $432,051.00 in 
restitution. Special conditions include the following: 1) Employment Requirement; 
2) Financial Disclosure Requirement; 3) No New Debt Restriction; 4) Travel; and 
5) Unpaid Restitution, Fines, or Special Assessment.

The defendant shall pay restitution at the rate of $100.00 per month, until such time as the 
Court may alter that payment schedule in the interest of justice.  The United States Probation 
Office and the United States Attorney’s Office shall monitor the payment of restitution and 
report to the Court any material change in the defendant’s ability to pay.  
 
CAUSE 
 
On October 22, 2024, the defendant commenced his term of supervised release in the Southern 
District of Florida. He was ordered to pay restitution in the amount of $432,051.00. He resides in 
Homestead, Florida with his wife and children. The defendant secured employment with Frito Lays in 
Miami, Florida as a delivery driver. The defendant is requesting to go to school full time Monday through 
Friday until July 2025 to finish the electric and carpentry portion for his journeymen’s license. He further 
stated he would work on the weekends with the BYB Bare Knuckle Boxing company domestic events. The 
defendant advised he is paid cash and will pay 15% of this income towards restitution. He further stated 
his brother is able to assist him with making his restitution payment of $100.00 a month while he is 
completing school.

The defendant has paid his $100.00 special assessment and DNA requirements. To date, the 
defendant has paid $300.00 towards his restitution with a remaining balance of $431,751.00.    On February 
25, 2025, the defendant submitted a money order in the amount of $125.00 towards his restitution payment 
for the month of February.  
 A financial investigation was conducted to determine the amount the defendant could afford to pay 
monthly. The information was compared to the documentation provided by the defendant and the expenses 
were adjusted accordingly. The defendant reported the household income as $5216.26 and monthly 
expenses such as mortgage $3,543.96, electric bill $380.00, phone bill $130.00, health insurance $500, 
groceries $500, water bill $300, and child support $972.00, leaving him a negative net cash flow of 
$1109.70.  Based on this information, it was determined that the defendant will be able to pay $100.00 per 
month towards restitution.  
 
The defendant was presented with this information and concurred with our assessment, and 
consequently, voluntarily signed the enclosed Waiver of Hearing to Modify Conditions of Supervised 
Release, thus establishing restitution at $100.00 per month, commencing March 2025, and every month 
thereafter. The financial litigation program has been made aware of the defendant’s release and 
confirmation of his enrollment into the Treasury Offset Program is pending.  
 
Recommendation:   
 
The defendant has complied with all other conditions of supervised release. It is respectfully 
requested Your Honor modify the conditions of supervised release allowing the defendant to pay restitution 
at a rate of $100.00 per month. The defendant is also requesting to attend school full time until July 2025 
to complete his journeymen’s license.
