IN THE UNITED STATES DISTRICT COURT FOR THE EASTERN DISTRICT OF PENNSYLVANIA ALICIA MARSHALL, et al., Plaintiffs, v. PRESTAMOS CDFI, LLC, Defendant. Civil Action No. 5:21-cv-04337-JMG STIPULATION OF DISMISSAL Plaintiffs Alicia Marshall, Paris Townsend, Kristina Henderson, Jamie Jones, John Martin, Gregory Lloyd, Alyshia Johnson, Lametria Marvel, Jahbrael Horne and Sharon Bradley Smith (collectively, “Plaintiffs”) and defendant Prestamos CDFI, LLC (“Defendant”) hereby stipulate and agree as follows: WHEREAS, on October 1, 2021 certain of the Plaintiffs filed this litigation against Defendant (Dkt. No. 1); WHEREAS, other of the Plaintiffs were added in subsequently filed amended complaints; WHEREAS, the Court granted in part and denied in part Defendant’s motion to dismiss on March 30, 2023 (ECF Nos. 56-57); WHEREAS, the Court granted in full the motion to dismiss filed by Defendant’s corporate parent Chicanos Por La Causa, Inc. on December 5, 2023 (ECF No. 93); WHEREAS, following discovery the Court denied Plaintiffs’ motion for class certification on April 30, 2025 (ECF Nos. 152-153); Case 5:21-cv-04337-JMG Document 174 Filed 09/09/25 Page 1 of 4 2 WHEREAS, Plaintiffs filed a motion for reconsideration of the Court’s denial of class certification on May 7, 2025 (ECF Nos. 154-155) which Defendant opposed (ECF No. 161) and Defendant filed a motion for summary judgment also on May 7, 2025 (ECF No. 157) which Plaintiffs opposed (ECF No. 163); WHEREAS, as previously reported to the Court, the parties reached an agreement to settle this litigation in full subject to entering into their written settlement agreement (ECF No. 169); WHEREAS, as also previously reported to the Court, the parties’ settlement is on an individual (i.e., non-class action) basis and therefore would not require the approval of the Court which has denied class certification (ECF Nos. 169, 152-153); WHEREAS, the parties have also now finalized and executed their settlement agreement; WHEREAS, as also previously reported to the Court (ECF No. 169), the parties’ settlement agreement provides that subject to compliance with the terms of the parties’ settlement, Plaintiffs with Defendant’s consent will file a notice voluntarily dismissing this lawsuit pursuant to Rule 41(a)(1)(A)(ii) of the Federal Rules of Civil Procedure, and the Court stayed all future dates, events and deadlines in this litigation until August 27, 2025 (ECF No. 170), which stay was extended to September 9, 2025 (ECF No. 172); NOW, THEREFORE, IT IS HEREBY STIPULATED AND AGREED, by and among all parties hereto: 1. Pursuant to Rule 41(a)(1)(A)(ii) of the Federal Rules of Civil Procedure, Plaintiffs with Defendant’s consent hereby dismiss with prejudice all of their claims against Defendant in this litigation. 2.
