During our March 12 discovery conference, the Court shared its intention to consolidate this case with Drevnak 
(23-2777) based on the history of these related cases and Plaintiffs’ expressed support for consolidation. Upon 
further consideration, the Court is uncertain whether consolidation is appropriate given that the named Plaintiffs 
and claims are distinct. Instead, the Court directs the parties to meet, confer, and discuss dismissing Drevnak 
(23-2777) and amending this case to incorporate Drevnak’s allegations. 
 
On the second page of the Drevnak complaint, plaintiffs state: “This case is brought by Plaintiffs who reside in 
or were injured by the alleged misconduct in additional states that are not included in Prestamos I, and who 
therefore may otherwise be denied the opportunity to obtain any relief for the alleged misconduct.” The Court 
requests that Plaintiffs consider whether this goal may be achieved by amending in Marshall because 
proceeding as a single case will promote judicial economy as is the goal of class actions.
