PRESTAMOS CDFI, LLC ⚠ EXTERNAL Dear Mr. Dixon: Thank you for your email. The parties have met and conferred as directed. The parties agree that Plaintiffs will file an amended complaint in Marshall that incorporates the allegations in Drevnak (23-2777) and to the dismissal of Drevnak (23-2777). Further, Plaintiffs’ amended complaint in Marshall will not add any new causes of action; will incorporate the claims of the plaintiffs in Drevnak; will add new plaintiffs from additional states who have retained us following the filing of the Drevnak action; and will drop the claims alleged by one plaintiff in the Drevnak action. Plaintiffs respectfully request 30 days to prepare and file their amended complaint in Marshall and that the Drevnak action not be dismissed until the amended complaint is filed in Marshall. Thank you. Respectfully, Lawrence J. Lederer ___________________________ Lawrence J. PRESTAMOS CDFI, LLC Importance: High CAUTION: External Email Counsel, During our March 12 discovery conference, the Court shared its intention to consolidate this case with Drevnak (23-2777) based on the history of these related cases and Plaintiffs’ expressed support for consolidation. Upon further consideration, the Court is uncertain whether consolidation is appropriate given that the named Plaintiffs and claims are distinct. Instead, the Court directs the parties to meet, confer, and discuss dismissing Drevnak (23-2777) and amending this case to incorporate Drevnak’s allegations. On the second page of the Drevnak complaint, plaintiffs state: “This case is brought by Plaintiffs who reside in or were injured by the alleged misconduct in additional states that are not included in Prestamos I, and who therefore may otherwise be denied the opportunity to obtain any relief for the alleged misconduct.” The Court requests that Plaintiffs consider whether this goal may be achieved by amending in Marshall because proceeding as a single case will promote judicial economy as is the goal of class actions. Thank you. Be well! Brian R. Dixon Civil Deputy Clerk to Judge John M.
