I, Karin B. Swope, hereby declare as follows:  
1. 
I am an attorney licensed to practice law in the State of Washington and 
appear in this matter pro hac vice. I am a partner in the law firm of Cotchett Pitre & 
McCarthy LLP, one of the lead counsel firms of record for Plaintiffs in this matter.  
2. 
I submit this Declaration in support of this ex parte request to appear at 
Plaintiffs’ Motion for Class Certification telephonically.  
3. 
This application is based on good cause and on the grounds that a family 
member has had to be evacuated due to the Palisades Fire in Los Angeles.  Due to the 
circumstances, it is advisable for me to not travel to San Diego this week and participate 
in the hearing on Plaintiffs’ Motion for Class Certification telephonically.  
4. 
Plaintiffs’ counsel responsible for presenting oral argument on Plaintiffs’ 
Motion for Class Certification will be personally present in the courtroom at the hearing 
on January 17, 2025.  Therefore, my appearance by telephone should not interfere with 
the hearing on Plaintiffs’ motion and will not result in prejudice to any party.

On January 14, 2025, I notified counsel for Defendant of my intent to 
request the subject relief by this ex parte application.  Defense counsel confirmed they 
have no objection to my appearing telephonically at the hearing on Plaintiffs’ Motion 
for Class Certification. 
6. 
I was not able to bring a fully noticed motion as the circumstances giving 
rise to this request arose outside the requisite time frame to bring a regularly noticed 
motion.   
I declare under penalty of perjury under the laws of the United States that the 
foregoing is true and correct. Executed on this 15th day of January 2025, at Seattle,
