On August 25, 2023, the Court held an informal video discovery conference 
regarding Defendant Bank of America, N.A.’s responses to Plaintiff Jennifer Yick’s 
written discovery.  As discussed with counsel at the conference, the Court SETS another 
Zoom Discovery Conference September 7, 2023, at 10:00 a.m.  with Class Plaintiffs and 
Defendant Bank of America, N.A. to address unresolved discovery issues.  No later than 
September 1, 2023, counsel for Class Plaintiffs and counsel for Defendant must 
exchange discovery position statements of no more than two pages, outlining their 
respective positions regarding Plaintiffs’ request for emails from certain high-ranking 
executives to the board of directors regarding Defendant’s use of fraud filters.  The
