Case called for Pretrial Conference. Parties reminded of March 28th trial date.
Jury to be pulled from Brunswick Division. Govt to have first 3 witness the first day -
Each side cautioned to have enough witnesses present each day thereafter. Jury selection and trial
process reviewed with parties - 32 jurors to be qualified with a total of 12 plus 2 for a
total of 14 to hear the case. The Government anticipates a total of 2-3 days for their case in
chief - defense anticipates 1/2 a day.
If the case is not concluded by Thursday evening, then the trial will resume on Monday
(no trial on Friday). The parties have submitted proposed voir dire, request to charge and
verdict form. At this point, there are no known witness issues. There will be an order issued
from Judge Cheesbro on the pending motions. Any party that disagree with his
ruling should appeal that order immediately as to resolve the appeal prior to trial.
Court takes up differences in verdict form and charge with each party. At this time, trial
to commence and before the charge conference, parties to confer to see if there is an
agreement. in the mean time, each side to provide the Court authority as to the verdict
form - any authority due Friday prior to trial (03/24). Government proposes the final
exhibit and witness list be disclosed to defense Friday prior to trial - no objection from
defense.
