This matter having come before the Court on the application of the defendant, Arlen 
Encarnacion, by his attorney, Lorraine Gauli-Rufo, as recommended by Pretrial Service Officer  
(“PTSO”) Brian Nauer, we are respectfully requesting a modification to Mr. Encarnacion’s 
conditions of bail to add two conditions: 1) Substance abuse testing and/or treatment as directed 
by Pretrial Services and 2) Refrain from the excessive use of alcohol. Mark Orlowski, United 
States Attorney, on behalf of the Government, having no objection to this request, it is therefore 
ordered that Mr. Encarnacion’s bail shall be modified to add  the two conditions set forth-
above.  All other bail conditions remain in full force and effect. 
For good cause shown, it is hereby Ordered: 
On this ____ day of August, 2023 the bail modification request is hereby granted.
