Criminal Case No. 23-60170-CR-Scola
Trial Order
This case is set to begin trial on Monday June 3, 2024, at 9:00 A.M. at
the Wilkie D. Ferguson, Jr. United States Courthouse, 400 N. Miami Avenue,
Courtroom 12-3, Miami, Florida. The Court orders the parties to file their
proposed voir dire questions (following the guidelines set forth in the Court’s
scheduling order setting trial date (ECF No. 14 at 2)) by May 28, 2024, and
their witness lists and exhibit lists by May 30, 2024. The Court will read the
parties’ witness lists to the prospective jurors during the selection process.
Consequently, the parties should endeavor to tailor their witness lists to
include only those witnesses whom they reasonably believe they will call to
testify. If a party does not intend to call any witnesses or to proffer any
exhibits, the party must file a Notice informing the Court that he or she will not
be filing a witness or exhibit list. This Notice is due by May 30, 2024.
The Court further orders the parties to file their proposed jury
instructions jointly, though they need not agree on each proposed instruction.
If the parties both agree on a proposed instruction, that instruction must be
set out in regular typeface. Instructions proposed only by the Government
must be underlined. Instructions proposed only by the Defendant must be
bold-faced. Every instruction must be supported by a citation of authority. The
parties must use as a guide the Eleventh Circuit Pattern Jury Instructions for
Criminal Cases, including the directions to counsel. The parties must jointly
file their proposed jury instructions (including a verdict form) via CM/ECF, and
must also submit their proposed jury instructions and verdict form to the
Court via e-mail at scola@flsd.uscourts.gov in Word format (.doc) by June 3,
2024.
The Court further orders the Government to submit a Word (.doc)
version of the Superseding Indictment (ECF No. 23) to the Court via e-mail at
scola@flsd.uscourts.gov. This editable version of the Superseding Indictment is
necessary in case the Court needs to provide the jury with a redacted version of

the Superseding Indictment. The Government must submit (via e-mail) this
editable version of the Superseding Indictment by June 3, 2024.
Additionally, in accordance with this Court’s Order Setting Trial Date,
the Government must turn over to defense counsel all anticipated Jencks Act
material no later than June 3, 2024, at 9:00 a.m.
Done and ordered, in Miami, Florida, on May 23, 2024.
