A BILL
To amend the Economic Aid to Hard-Hit Small Businesses,
Nonprofits, and Venues Act with respect to grants for
shuttered venue operators, and for other purposes.
1 Be it enacted by the Senate and House of Representa-
2 tives of the United States of America in Congress assembled,
3 SECTION 1. GRANTS FOR SHUTTERED VENUE OPERATORS.
4 (a) ELIGIBLE PERSON OR ENTITY.—Section
5 324(a)(1) of the Economic Aid to Hard-Hit Small Busi-
6 nesses, Nonprofits, and Venues Act (title III of division
7 N of Public Law 116–260) is amended—

8 (1) in subparagraph (A)—

1 (A) in the matter preceding clause (i), by
2 inserting ‘‘an attraction operator,’’ after ‘‘mo-
3 tion picture theatre operator,’’;
4 (B) in clause (i)—
5 (i) in the matter preceding subclause
6 (I), by inserting ‘‘the attraction operator,’’
7 after ‘‘motion picture theatre operator,’’;

1 (i) by inserting ‘‘the attraction oper-
2 ator,’’ after ‘‘the motion picture theatre
3 operator,’’ each place it appears; and
4 (ii) by inserting ‘‘attractions,’’ after
5 ‘‘motion picture theatres,’’ each place it
6 appears; and
7 (2) in subparagraph (B), by inserting ‘‘an at-
8 traction operator,’’ after ‘‘motion picture theatre op-
9 erator,’’.
10 (b) ATTRACTION OPERATOR.—Section 324(a) of the
11 Economic Aid to Hard-Hit Small Businesses, Nonprofits,
12 and Venues Act (title III of division N of Public Law 116–
13 260) is amended by adding at the end the following new
14 paragraph:
15 ‘‘(11) ATTRACTION OPERATOR.—
16 ‘‘(A) IN GENERAL.—The term ‘attraction
17 operator’ means an individual or entity that—
18 ‘‘(i) as the principal business activity
19 of the individual or entity, owns or oper-
20 ates an—
21 ‘‘(I) amusement park;
22 ‘‘(II) amusement arcade or par-
23 lor; or
24 ‘‘(III) amusement device or con-

1 ‘‘(ii) includes an individual or entity
2 described in clause (i) that—
3 ‘‘(I) operates for profit;
4 ‘‘(II) is a nonprofit organization;
5 ‘‘(III) is government-owned; or
6 ‘‘(IV) is a corporation, limited li-
7 ability company, or partnership or op-
8 erated as a sole proprietorship.
9 ‘‘(B) EXCLUSION.—An individual or entity
10 that owns or operates a business described in
11 subclause (I), (II), or (III) of subparagraph
12 (A)(i) may not be treated as an ‘attraction op-
13 erator’ if gambling activities are carried out as
14 part of such business.’’.
