1 Be it enacted by the Senate and House of Representa-
2 tives of the United States of America in Congress assembled,
3 SECTION 1. SHORT TITLE.
4 This Act may be cited as the ‘‘Transparency and Pre-
5 dictability in Small Business Opportunities Act’’.
6 SEC. 2. SMALL BUSINESS ADMINISTRATION RULES FOR
7 CANCELLED COVERED SOLICITATIONS.
8 (a) IN GENERAL.—Not later than 180 days after the
9 date of the enactment of this Act, the Administrator of
10 the Small Business Administration shall issue rules to
11 carry out the following actions:
12 (1) Disclose information about a covered solici-
13 tation that was issued and cancelled that includes
14 the following:
15 (A) A justification for the cancellation of
16 such covered solicitation.
17 (B) Available information about any plans
18 to reissue such covered solicitation and any as-
19 sociated timeframes for such reissuance.
20 (C) Available information about any plans
21 to include the requirements such covered solici-
22 tation in another contract or task order of the
23 Federal agency.
24 (2) With respect to a cancelled covered solicita-

1 issue, procedures for the referral of a small business
2 concern that prepared a bid for such covered solici-
3 tation to the Director of Small and Disadvantaged
4 Business Utilization (as defined in section 15(k) of
5 the Small Business Act (15 U.S.C. 644(k))) of the
6 Federal agency for assistance in identifying similar
7 contracting opportunities.
8 (b) PUBLICATION.—The information required under
9 subsection (a) shall be made publicly accessible on the sin-
10 gle governmentwide point of entry described under section
11 1708 of title 41, United States Code.
12 (c) COVERED SOLICITATION DEFINED.—The term
13 ‘‘covered solicitation’’ means a solicitation of a Federal
14 agency for a procurement for which two or more small
15 business concerns were eligible to submit a bid.
16 SEC. 3. DUTIES FOR DIRECTORS OF OFFICES OF SMALL
17 AND DISADVANTAGED BUSINESS UTILIZA-
18 TION RELATING TO CERTAIN CANCELLED SO-
19 LICITATIONS.
20 Section 15(k) of the Small Business Act (15 U.S.C.
21 644(k)) is amended—
22 (1) in paragraph (21), by striking the period at
23 the end and inserting ‘‘; and’’; and
24 (2) by adding at the end the following new

1 ‘‘(22) shall, when notified by a small business
2 concern that a Federal agency cancelled a solicita-
3 tion for which such concern prepared a bid and such
4 Federal agency does not intend to reissue, assist
5 such concern with identifying similar contracting op-
6 portunities.’’.
7 SEC. 4. COMPLIANCE WITH CUTGO.
8 No additional amounts are authorized to be appro-
9 priated to carry out this Act or the amendments made
10 by this Act.
