                             O R D E R


           Pending before the court are the Joint Motion for

Order Directing Administrative Forfeiture to be Applied to

Criminal Restitution [ECF No. 41], and a Joint Motion to Deposit

Funds into the Registry of the Court [ECF No. 42].             In the

Motions, the parties request that administrative forfeiture of

funds in the approximate amount of $6,590.00 be applied to

restitution and the funds be sent from the United States Marshal

Service directly to the Clerk of the United States District

Court for the Southern District of West Virginia to be held in

the Court Registry until a restitution order is entered in this

criminal action.


          Upon consideration of each Motion, it is ORDERED that

the Motions be, and they hereby are, GRANTED, and the Clerk of

this Court shall take receipt of any such funds tendered by or

on behalf of the defendant and deposit the funds into the Court

Registry, until further order of this court.


           The Clerk is directed to forward copies of this order

to the defendant, all counsel of record, the United States
