PLAINTIFFS’ BRIEF IN SUPPORT OF MOTION FOR LEAVE TO FILE JOINT
APPENDIX IN OPPOSITION TO DEFENDANT’S MOTION FOR
SUMMARY JUDGMENT UNDER SEAL
Plaintiffs, though the undersigned counsel, respectfully submit this Brief in Support of
their motion for leave to file their Joint Appendix in Opposition to Defendant’s Motion for
Summary Judgment Under Seal.
I.
Background
On January 18, 2022, the Court granted the parties’ Joint Motion for Entry of
Confidentiality Agreement and Protective Order (the “Protective Order”). See ECF No. 20. The
Protective Order, inter alia, recognized that certain discovery material may contain information
designated by a party to be Confidential or Highly Confidential and provided appropriate
protections against the public disclosure of that information.
On May 7, 2025, Defendant filed a Motion for Summary Judgment along with an
Appendix in Support of their motion. See ECF Nos. 157 and 158. Plaintiffs’ Opposition to
Defendant’s Motion for Summary Judgment, which is being filed concurrently herewith,
identifies and explains the reasons why Defendant’s motion for summary judgment should be
denied. Plaintiffs’ Opposition is supported by their Joint Appendix (the “Appendix”) containing

new evidence that Defendant’s motion omits in accordance with Local Rule 5.1.5 and the
Court’s Policy and Procedure II. B. 5. Plaintiffs’ Appendix contains certain documents and
information that have been designated as Confidential and/or Highly Confidential, such as tax
documents, bank records, and other sensitive personal financial information.
II.
Argument
The Court should grant Plaintiffs’ Motion for Leave to File Under Seal for the same
reasons set forth in Prestamos’ motion to seal (ECF No. 156), which the Court granted. ECF No.
160.
III.
Conclusion
Accordingly, Plaintiffs’ respectfully request that the Court grant Plaintiffs leave to file their
Joint Appendix in Opposition to Defendant’s Motion for Summary Judgment Under Seal.
