(SECOND SUPERSEDING)
ORDER
The government has informed the Court that it has reason to believe
that Defendant Mark T. Sargent died on May 31, 2021. Accordingly, pursuant
to Rule 48(a) of the Federal Rules of Criminal Procedure and United States v.
Matta, 937 F.2d 567, 568 (llth Cir. 1991), the government has filed a motion
for leave of court to dismiss the Second Superseding Indictment as to
Defendant Mark T. Sargent.
Therefore, for good cause shown, the government's motion is hereby
granted, and the Second Superseding Indictment is hereby dismissed as to
Defendant Mark T. Sargent. The charges in the Second Superseding
Indictment remain intact against the other Defendants.
