ORDER 
This case is before the Court on Defendant Daniel Jay’s oral motion to 
continue the pretrial conference scheduled for April 14, 2021.  On April 12, 2021, 
chambers staff emailed Mr. Jay and copied standby counsel, Leigh Finlayson, to 
state whether Mr. Jay would be moving forward with the pretrial conference.  Mr. 
Jay responded as follows: 
third party intervenor, real party in interest, being 
harmed. Agent of record for the Private Business 
Trust DANIEL∙ERIC∙JAY, as the Internationally 
Protected Person, the name being surrendered to the 
Office of The Commander in Chief of the United 
States Army and Navy, appreciates and accepts the

offer of continuance, and will need ninety days for 
preparation. (see attached)1 
The Court interprets this response as an oral motion to continue the pretrial 
deadlines.  Upon consideration, Mr. Jay’s request as to continuing the pretrial 
deadlines is GRANTED.   However, the request is DENIED as to Mr. Jay’s 
request for a ninety days extension.  Mr. Jay has had since February 12, 2021, to 
mail a two terabyte hard drive to the government in order to obtain the discovery 
in this case.   
Defendant Daniel Jay shall have until May 18, 2021 to file any necessary 
pretrial motions.  The pretrial conference is hereby rescheduled to Wednesday, 
May 19, 2021, at 10:00 a.m.2   
1 Mr. Jay also attached three images to his email that appear to show tracking 
information for a package he sent to Assistant U. S. Attorney, Russell Phillips.  The 
Court attaches those images as Attachment A. 
2 In light of the Public Health State of Emergency that currently exists in the 
State of Georgia due to the spread of the Coronavirus/COVID-19, the pretrial 
conference will be conducted via Zoom.  The Court will send meeting instructions 
to all parties via email and/or docket entry in CM/ECF a week prior to the pretrial 
conference.

The Clerk is DIRECTED to exclude time between the original and the 
rescheduled pretrial conference hearing, under the Speedy Trial Act because 
the ends of justice outweigh the best interest of the public and the defendant in 
a speedy trial pursuant to Title 18 United States Code, Section 3161(h)(7)(A) 
and (B)(i).
