UNOPPOSED MOTION TO CONTINUE DEADLINE TO RETAIN COUNSEL 
 
 
COMES NOW the Defendant, MAURICE FAYNE, by and through 
undersigned counsel and respectfully requests a continuance of the deadline to retain 
counsel, imposed by the Honorable Linda T. Walker in an Order dated July 9, 2020.  
(Doc. 25).  In support of this Motion, Defendant shows as follows:

Mr. Fayne was named in a magistrate complained filed on May 12, 2020, 
alleging a violation of 18 U.S.C. § 1344.  (Doc. 1).  Mr. Fayne made his initial 
appearance on May 13, 2020 and was released on bond.  (Doc. 7).   While Mr. Fayne 
originally retained counsel to represent him in this case, his attorney, Tayna Miller, 
filed a motion to withdraw, which was granted. (See Docs. 14, 21).  An indictment 
was returned on June 24, 2020, and undersigned counsel was appointed to represent 
Mr. Fayne the next day.  (Docs. 17, 22). An arraignment was scheduled for July 9, 
2020.  (Doc. 20).

At the arraignment, Mr. Fayne did not enter a plea and instead asked for 
additional time to retain new counsel.  (Doc. 25).  This Court continued the 
arraignment and entered an Order requiring Mr. Fayne notify the court of counsel 
employed by 2:00 p.m. on July 14, 2020.   (Id.) 
 3. 
 
Mr. Fayne requests one additional week to seek and retain new counsel of his 
choosing.  He also requests a continuance of his arraignment, as yet to be scheduled, 
to allow him to appear with new counsel.

Assistant United States Attorney Russell Phillips does not oppose this motion.    
 
WHEREFORE, Mr. Fayne respectfully requests one additional week to seek 
and retain counsel of his choice, and for his arraignment be continued to a date 
thereafter.
