Sentencing Hearing(Sentencing Hearing Non-evidentiary);
Defendant verified he waives his right to an in-person hearing and consents to 
proceed via Zoom video call. Defendant withdrew objection to the guideline 
calculations. Defendant raised factual objections to the PSR, which the Court 
sustained. PSR adopted by the Court to which no other objections were been raised. 
The Court presented guideline calculations and sentencing options and heard 
argument from counsel regarding a reasonable sentence. Defendant allocuted. 3553 
factors given. The Court adopts the joint request for a downward variance and 
sentences Defendant to 18 MONTHS confinement and 3 YEARS of Supervised 
Release as to Count 18 of the second superseding indictment, $100 special 
assessment, fine waived. The Court grants Defendant's request to apportion 
restitution over the government's objections. Defendant is ordered to pay 
$163,620.40 in restitution, jointly and severally. The Court will also recommend 
Defendant be designated to a minimum security facility or camp nearest to Rochester 
Hills, Michigan and orders his report date to occur no earlier than January 31, 2023. 
No objections to the sentence. Appeal rights given. Defendant to remain on pretrial 
release until surrender date.
