IN THE UNITED STATES DISTRICT COURT FOR THE EASTERN DISTRICT OF VIRGINIA Alexandria Division UNITED STATES OF AMERICA v. CRAIG DAVIS, Defendant. Case No.: 1:24CR-40 MOTION TO SUBSTITUTE COUNSEL The defendant, CRAIG DAVIS, brings this Unopposed Motion to Substitute Counsel, requesting the Court grant permission for the Federal Defender’s Office to withdraw and to substitute Jonathan A. Simms as attorney of record for Defendant in this matter, and in support thereof would show: 1. Cadence Mertz, Esquire (Federal Defender’s Office) was previously appointed to represent the Defendant in this cause. However, Mr. Davis has now retained the services of Jonathan A .Simms, Esquire to represent him in this matter. 2. Craig Davis approves of this substitution. This Motion is not brought for delay, but to allow Defendant to be represented by counsel of his choice. Attorney Mertz and the Government have been consulted, and have no objection to the requested relief. WHEREFORE, PREMISES CONSIDERED, Craig Davis prays that the Court enter an order allowing Cadence Mertz to withdraw from representing Defendant and to substitute Jonathan A.
