Summary

Minutes of a telephone criminal status conference held November 12, 2024 in United States v. Carnisha Maurica Rogers, No. 3:24-cr-00190-WWB-SJH, in the U.S. District Court for the Middle District of Florida, before Judge Wendy W. Berger; the minutes are Doc. 27. The minutes record that the defendant requested a 90-day continuance citing voluminous discovery, and that the government had no objection. The court granted the motion and continued the trial to the March 2025 trial term, with a status conference set for February 11, 2025. Citing 18 U.S.C. § 3161(h)(7)(B), the court found the time until and including March 31, 2025 excludable under 18 U.S.C. § 3161(h) and directed the defense to file a waiver of speedy trial.

PROCEEDINGS OF: TELEPHONE CRIMINAL STATUS CONFERENCE

The case was called, and appearances were taken.

Defendant requests a 90-day continuance due to voluminous discovery and mental
health issues.

The Government has no objection to the continuance request.

Defense expects the Defendant to plea. If the case goes to trial it is estimated to take 4-
5 days.

The Court grants the motion to continue the trial to the March 2025 trial term with a
status conference set for February 11, 2025, at 9:30 a.m. After considering all the
factors, including those set forth in 18 U.S.C. § 3161(h)(7)(B), and for the reasons stated
on the record and in the motion, the Court finds that the ends of justice served by
granting such a continuance outweigh the best interest of the public and the defendant(s)
in a speedy trial. The Court, therefore, determines that the time from today until and
including March 31, 2025, shall be "excludable time" pursuant to 18 U.S.C. § 3161(h).

Defense shall file a waiver of speedy trial on the docket.

Court adjourned.
