ORDER SETTING HEARING 
 
 
Defendant’s counsel, Albert Z. Levin, Esq., has filed a Motion to Withdraw and 
Request for Appointment of Appellate Counsel, which the Honorable Donald M. 
Middlebrooks has referred to me for resolution. (ECF Nos. 72, 78). The Court will hold a 
hearing on the Motion on December 2, 2021 at 2:00 p.m. at the C. Clyde Atkins United 
States Courthouse, 301 N. Miami Avenue, Sixth Floor, Miami, Florida 33128. Prior to your

In the Eleventh Circuit, retained counsel for a criminal defendant cannot cease to 
represent the defendant, and new counsel cannot be appointed, until after the court conducts 
“an in camera review of the financial circumstances of the defendant and of the fee 
arrangements between the defendant and retained counsel.” Addendum Four, subparagraph 
(d)(2), Eleventh Circuit Court of Appeals’ Plan under the Criminal Justice Act.  
Defense counsel Albert Z. Levin, Defendant Carlos Vazquez, and the Assistant 
United States Attorney shall be present at the hearing. Local Rule 88.7 sets forth various

factors this Court must consider in resolving the Motion and defense counsel shall be 
prepared to address the factors applicable to this case at the hearing.
