NONCOMPLIANCE SUMMARY

Violation Number Nature of Noncompliance

1. Violation of Additional Conditions of Release Number 7(m): The
defendant must not use or unlawfully possess a narcotic drug or other
controlled substances defined in 21 U.S.C. § 802, unless prescribed by
a licensed medical practitioner:

On September 7, 2022, the defendant submitted a urine specimen that tested
positive for marijuana. The specimen was confirmed positive by the
national testing laboratory on September 20, 2022. Mr. Butler denies using
any illegal substances since August 29, 2022, prior to his release on bond.

U.S. Probation Officer Action:

Mr. Butler is currently participating in random urine screening through the Court’s contracted
treatment provider located in St. Albans, West Virginia. It is noted, the defendant admitted using
marijuana prior to his arrest for the instant offense and denies additional use of marijuana while
on bond. The probation officer will closely monitor the defendant’s urine screening results to
assess and address any substance abuse risks or needs. Should he continue to submit positive urine
specimens the probation officer plans to enroll the defendant in outpatient substance abuse
counseling sessions. All future noncompliances will be reported to the Court.
