MINUTE ORDER
The Court GRANTS in part and DENIES in part the Non-party’s, FSX’s, motion to
intervene and motion for a protective order pursuant to Fed. R. Civ. P. 24(b), 26(b), and 26(c).
In addition, the Court orders the Parties to designate FSX’s service agreement as “Highly
Confidential – Attorney’s Eyes Only.”
The Court grants permissive intervention for the limited purpose of preserving
confidentiality of the Non-Party’s service agreement.
Plaintiff demonstrated that FSX’s service agreement appears relevant to the claims plead
and is thus entitled to it in discovery. There is no significant burden in providing the service
agreement particularly in view of its protection by the AEO protective order.
This order disposes of Docket No. 88.
