1 UNITED STATES DISTRICT COURT MIDDLE DISTRICT OF FLORIDA FORT MYERS DIVISION UNITED STATES OF AMERICA v. Case No. 2:21-cr-74-TPB-MRM AMBER BRUEY _ _/ NOTICE OF CONSENT TO PROCEED BY VIDEO CONFERENCE The defendant, Ms. Bruey, through counsel, advises the Court that the defendant consents to change her plea from not guilty to guilty through video conferencing so long as the waiver of her personal appearance at a change-of-plea hearing would serve to expedite that hearing. This notice and waiver are filed following consultation with defendant’s counsel and in the wake of the continuing and wide-ranging public-health implications of the COVID-19 pandemic. Therefore, the defendant consents to proceed to a change of plea hearing by video conferencing. Further, the defendant advises that, following consultation with her attorney, she consents to proceed at any change of plea hearing before a United States Magistrate Judge. Should the Court desire, the defendant shall provide a sworn and personal memorialization of her consent to proceed before a United States Magistrate Judge and by video teleconferencing at any future hearing in this matter. Case 2:21-cr-00074-TPB-K_D Document 65 Filed 03/03/22 Page 1 of 3 PageID 149 2 The defendant also waives the fourteen-day, objection period to the Magistrate Judge’s Report and Recommendation and consents to the District Judge acting on the Report and Recommendation and setting a date for sentencing. Should the Court desire, the defendant shall provide a sworn and personal memorialization of this waiver and consent by video teleconferencing at any future hearing in this matter. Should this matter proceed by video conferencing, undersigned counsel respectfully advises the Court it would be prudent for defense counsel to confer with Ms. Bruey through the means of video conferencing to be provided by the Court and prior to commencement of the change-of-plea hearing. Undersigned counsel respectfully submits that such a conference with the defendant is not anticipated to last longer than thirty [30] minutes and could take place immediately prior to the commencement of the change-of-plea hearing.
