NOTICE REGARDING DEFENDANT ALETA THOMAS’S
ELECTION REGARDING APPEAL
Counsel for the defendant, Aleta Thomas, hereby states to the Court as follows:
1.    That he has repeatedly requested that Ms. Thomas consult with him as to whether to
file a Notice of Appeal or an Election Not to Appeal.  Ms. Thomas had declined to consult with
the undersigned counsel and has not indicated a desire to appeal or a desire not to appeal
2.    That he was contacted by an attorney Matthew Allen Chivari,
LOWTHER |WALKER LLC, 101 Marietta Street, NW, Suite 3325, Atlanta, GA 30303, who
stated that he had been retained by Ms. Thomas to represent her.  On this date, Mr. Chivari
emailed the undersigned to state that he did not believe that an appeal would be advisable and
would not have merit.  In spite of this communication, Ms. Thomas has not provided her
signature for an Election Not To Appeal as directed by this Court.
