[PROPOSED] ORDER 
 
 
This matter having come before the Court on the motion of Defendant Adrienne Ponzo, 
through counsel Troy A. Archie, Esq., seeking (1) a stay of all proceedings in this matter pending 
the Third Circuit’s resolution of the consolidated litigation concerning the authority of Alina 
Habba to serve as Acting United States Attorney for the District of New Jersey; (2) permission to 
join, intervene, or adopt the arguments in the matters consolidated before Chief Judge Matthew 
W. Brann in United States v. Giraud and United States v. Pina; and (3) clarification from the 
Government regarding supervisory and approval procedures within the U.S. Attorney’s Office 
during the pendency of that litigation; and the Court having considered the submissions of the 
parties and for good cause shown; 
 
 
IT IS on this ___ day of __________, 2025, ORDERED as follows: 
 
a) All proceedings in Criminal No. 24-cr-267 (KMW)  are hereby STAYED pending a final 
decision from the United States Court of Appeals for the Third Circuit regarding the 
legality of Alina Habba’s service as Acting United States Attorney for the District of 
New Jersey and including the sentencing currently scheduled for December 3, 2025 at 
11:00 a.m., pending the Third Circuit’s final decision in United States v. Habba and the 
consolidated Giraud litigation. 
b) Defendant Adrienne Ponzo is granted leave to join, intervene in, or adopt the arguments 
raised in the consolidated matters of United States v. Giraud and United States v. Pina, 
including any related appellate proceedings. 
c) The United States shall submit a written statement within fourteen (14) days of this Order 
identifying the procedures and supervisory processes governing the approval,

authorization, and conduct of criminal prosecutions in the District of New Jersey during 
the pendency of the litigation regarding Ms. Habba’s asserted authority. 
d) The Court retains jurisdiction to modify or lift this stay upon application of any party or 
upon further order of the Court, and to enter such further relief as may be appropriate.
